Welcome to HouzTask. These Terms of Use (“Terms”) constitute a legally binding agreement between you and HouzTask, Inc. (“HouzTask,” “we,” “us,” or “our”) governing your access to and use of our website at houztask.com, our mobile applications, and all related services (collectively, the “Services”).
By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use our Services.
Plain-language summary: These Terms explain the rules of using HouzTask, what we’re responsible for, what we’re not, and what happens if something goes wrong. Each section opens with a plain summary of what it means for you.
Acceptance of Terms
Using HouzTask means you agree to these rules. If you don’t agree, please don’t use the platform.
Your use of the Services constitutes acceptance of these Terms, which may be updated from time to time. These Terms apply to all visitors, registered users, homeowners, contractors, and any other person who accesses the Services.
These Terms incorporate by reference our Privacy Policy and Safety Policy. In the event of a conflict between these Terms and another policy, these Terms govern unless otherwise stated.
These Terms contain a binding arbitration clause and class action waiver in Section 12. Please read that section carefully, as it affects your legal rights in any dispute with HouzTask.
Accounts & Eligibility
You must be 18 or older to use HouzTask. Keep your account secure — you’re responsible for what happens under it.
Eligibility. You must be at least 18 years old and capable of entering into a legally binding contract to use the Services. By using the Services, you represent and warrant that you meet these requirements.
Account registration. Certain features require you to create an account. You agree to provide accurate, current, and complete information and to keep it updated. You may not impersonate any person or entity or use a name that is not your own.
Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@houztask.com if you suspect unauthorized access.
One account per person. Each user may maintain only one personal account. Creating multiple accounts to circumvent restrictions or bans is prohibited.
Homeowner accounts
Free to create. Used to submit repair requests, check quotes, message contractors, and leave reviews. You are solely responsible for any agreements you enter with contractors.
Contractor (Pro) accounts
Subject to additional vetting requirements, contractor-specific terms, and service fees. Contractors must keep credentials current and comply with all applicable licensing laws in their jurisdiction.
HouzTask's Role as a Marketplace Platform
HouzTask connects you with contractors — we are not a contractor ourselves. Any work contract is between you and the contractor directly.
HouzTask is a technology marketplace. We provide a platform that enables homeowners to discover, evaluate, and connect with independent contractors. HouzTask does not itself perform home repair services, employ contractors, or supervise any work performed.
Contractors are independent. All contractors on the platform are independent third parties, not employees, agents, or representatives of HouzTask. HouzTask does not control the means, methods, or results of any contractor’s work.
Contracts are between you and the contractor. Any agreement for home repair services is entered into solely between the homeowner and the contractor. HouzTask is not a party to that agreement and has no obligations under it.
AI tools are informational only. HouzTask’s AI-powered repair guidance and quote analysis features are provided for general informational purposes only. They do not constitute professional engineering advice, licensed contractor assessments, or legal opinions. Always verify AI-generated information with a qualified professional before acting on it.
Important: HouzTask’s vetting and verification processes reduce risk but do not guarantee contractor quality, safety, or performance. Homeowners are encouraged to independently verify credentials and obtain written contracts before any work begins.
Acceptable Use & Prohibited Conduct
Use HouzTask honestly and lawfully. Don’t abuse the platform, deceive other users, or try to circumvent our systems.
You agree to use the Services only for lawful purposes and in accordance with these Terms. The following are expressly permitted and prohibited:
HouzTask reserves the right to investigate any suspected violation and to take appropriate action, including account suspension or termination, removal of content, and referral to law enforcement.
Your Content
You own what you post. By posting it, you give us a limited license to display and use it to operate the platform.
Ownership. You retain full ownership of any text, photos, reviews, messages, or other content you submit to the Services (“User Content”).
License to HouzTask. By submitting User Content, you grant HouzTask a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, and adapt your User Content solely to operate, improve, and promote the Services. This license ends when you delete your content or close your account, except where copies exist in backups or have been shared with others through normal platform operation.
Your representations. You represent that you own or have the necessary rights to submit your User Content, that it does not infringe any third party’s intellectual property or privacy rights, and that it complies with these Terms.
Content moderation. HouzTask may, but is not obligated to, review, edit, or remove User Content that violates these Terms or our Community Guidelines. Removal of content does not create liability on HouzTask’s part.
Do not post content that contains personal financial information, government ID numbers, or sensitive private data of any third party.
Intellectual Property
Everything HouzTask created — the name, design, software, and content — belongs to HouzTask. You can use the platform; you can’t copy it.
The Services and all content, features, and functionality on HouzTask — including but not limited to the HouzTask name, logo, trade dress, software, text, graphics, data, and AI tools — are owned by HouzTask, Inc. or its licensors and are protected by U.S. and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose. This license does not include the right to: reproduce or distribute any part of the Services; create derivative works; reverse-engineer any software; or use the Services for commercial purposes not expressly permitted.
If you believe your intellectual property rights have been infringed, please contact us at legal@houztask.com with a description of the alleged infringement.
Payments & Fees
HouzTask is free for homeowners. Contractors pay fees for leads and subscriptions. Payments are processed securely via Stripe.
Homeowner use. Core features of HouzTask — including repair guidance, quote checking, and contractor discovery — are free for homeowners. We will notify you clearly of any features that require payment before you incur a charge.
Contractor fees. Contractors may be subject to lead fees, subscription fees, or other charges as described in the contractor-specific fee schedule presented at registration and updated periodically. All fees are disclosed before payment is required.
Payment processing. Payments are processed by Stripe, Inc., a third-party payment processor. Your payment information is subject to Stripe’s terms and privacy policy. HouzTask does not store full payment card details.
Refunds. All fees are non-refundable unless otherwise stated or required by applicable law. If you believe you have been charged in error, contact billing@houztask.com within 30 days of the charge.
Taxes. You are responsible for all taxes associated with your use of the Services where applicable.
Disclaimers & Warranties
We provide the platform as-is. We can’t guarantee everything will always work perfectly or that every contractor will deliver perfect results.
AS-IS BASIS. THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
HouzTask does not warrant that: (a) the Services will be uninterrupted, error-free, or secure; (b) any defects will be corrected; (c) the Services or servers are free of viruses or harmful components; (d) information provided by contractors or AI tools is accurate, complete, or reliable.
Contractor disclaimer. HouzTask does not warrant the quality, safety, legality, or completeness of any work performed by contractors introduced through the platform. Homeowners engage contractors at their own risk and should verify credentials independently.
AI tools disclaimer. Repair guidance and quote analysis outputs generated by AI tools are estimates based on available data and are not a substitute for in-person professional assessment. HouzTask is not liable for decisions made in reliance on AI-generated content.
Some jurisdictions do not allow exclusion of implied warranties. In such jurisdictions, the above disclaimers apply to the maximum extent permitted by applicable law.
Limitation of Liability
If something goes wrong, our financial liability to you is capped. We’re not liable for contractor work, AI errors, or indirect losses.
EXCLUSION OF CONSEQUENTIAL DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOUZTASK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF HOUZTASK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Liability cap. HouzTask’s total aggregate liability to you for any claims arising out of or relating to these Terms or the Services shall not exceed the greater of: (a) the total fees paid by you to HouzTask in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100.00).
Contractor work. HouzTask has no liability for property damage, personal injury, financial loss, or any other harm arising from work performed by contractors introduced through the platform. Such disputes are between the homeowner and the contractor.
These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise). Some jurisdictions do not allow limitations on liability; in such cases the above limitations apply to the fullest extent permitted by law.
Indemnification
If your actions on our platform cause legal problems for HouzTask, you agree to cover our costs.
You agree to defend, indemnify, and hold harmless HouzTask, Inc. and its officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:
- Your access to or use of the Services;
- Your User Content;
- Your violation of these Terms;
- Your violation of any third-party right, including any intellectual property, privacy, or property right;
- Any dispute between you and a contractor or other user of the Services;
- Any claim that your User Content caused damage to a third party.
HouzTask reserves the right to assume exclusive control of any matter subject to indemnification by you, at your expense. You agree to cooperate fully with HouzTask’s defense of such claims.
Termination
You can close your account anytime. We can suspend or close accounts that violate these Terms.
By you. You may close your account at any time through your account settings or by emailing support@houztask.com. Closure does not entitle you to a refund of any fees paid.
By HouzTask. HouzTask may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including but not limited to: violation of these Terms; conduct that we determine is harmful to other users, contractors, or the platform; or if we discontinue the Services.
Effect of termination. Upon termination, your right to access the Services ceases immediately. Sections of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, limitation of liability, indemnification, and governing law — will survive.
Data after termination. Following account closure, we handle your data in accordance with our Privacy Policy.
Governing Law & Dispute Resolution
Disputes are resolved by binding arbitration, not in court. You waive the right to join a class action. This is a significant legal provision — please read it.
Governing law. These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions, except where local consumer protection law requires otherwise.
Informal resolution. Before initiating any formal dispute, you agree to contact HouzTask at legal@houztask.com and attempt to resolve the matter informally for at least 30 days.
Binding arbitration. If informal resolution fails, any dispute, claim, or controversy arising from or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator’s decision shall be final and binding. Arbitration shall be conducted in English and, where applicable, may proceed remotely.
Class action waiver. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN ARBITRATION, BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL.
Exceptions. Either party may bring an individual action in small claims court. Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
Time limit. Any claim arising under these Terms must be brought within one (1) year of the event giving rise to the claim, or be permanently barred.
Changes to These Terms
We’ll give you advance notice of any significant changes. Continued use after the effective date means you accept them.
HouzTask reserves the right to modify these Terms at any time. When we make material changes, we will:
- Post the revised Terms on this page with an updated “Last updated” date
- Send registered users email notice at least 14 days before changes take effect
- Display a prominent notice on our website for 30 days following material changes
Your continued use of the Services after the effective date of any revision constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services and may close your account before the effective date.
